Terms of Service for Smoke Dating App

These Terms of Service (“Terms”) govern your access to and use of the Smoke mobile application and related services (the “App”), operated by Smoke, Inc. (“Smoke,” “we,” “us,” or “our”).

By creating an account or using the App, you agree to these Terms.

1. Eligibility
You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are 18 or older.

We do not knowingly allow individuals under 18 to use the App, and we may terminate accounts if we believe a user is underage.

2. Description of the Service
Smoke is a platform designed to facilitate real-world social introductions and meetups between users.

Key characteristics of the App include:
Users create profiles with personal information and photos
Users are shown other users and may express interest in meeting
Users coordinate real-world meetups
The App does not currently provide in-app messaging between users
Users interact primarily through the intent to meet in person

We may modify, suspend, or discontinue features at any time.

3. Account Registration
To use the App, you may be required to create an account using:
email address
phone number
Apple Sign-In
Google Sign-In

You agree to provide accurate, current, and complete information, including your real identity where required.

You are responsible for maintaining the security of your account and all activity under it.

4. User Content
You may upload or provide content including:
profile photos
personal information (age, gender, preferences, etc.)
optional responses or profile information
audio or video content (if enabled)
meetup-related information
reviews or feedback about other users

You retain ownership of your content, but you grant Smoke, Inc. a worldwide, non-exclusive, royalty-free license to use, display, reproduce, distribute, and process such content for the purpose of operating and improving the App.

We may remove, edit, or restrict access to content at our sole discretion for any reason.

We may retain certain information as required or permitted by law, including for safety, fraud prevention, and operational integrity.

5. Prohibited Content and Conduct
You agree not to:
upload nudity, sexually explicit content, obscene material, or pornography
engage in illegal activity
impersonate another person
harass, abuse, threaten, or harm others
misrepresent your identity, age, or intentions
use the App for scams, fraud, or deceptive purposes
upload content that violates laws or third-party rights
attempt to disrupt or misuse the App

We reserve the right to remove content or suspend accounts at our sole discretion.

6. Real-World Interactions and Safety
The App is designed to facilitate in-person meetings between users.
You understand and agree that:
Smoke does not control or supervise real-world interactions between users
We do not verify all user identities or backgrounds
We do not guarantee the safety, conduct, or intentions of users

You are solely responsible for your interactions with other users, both online (if applicable) and offline.

We strongly encourage users to:
meet in public places
exercise caution and judgment
prioritize personal safety at all times

Smoke, Inc. is not responsible for any injury, loss, harm, or damages resulting from interactions between users.

We do not control user behavior, including interactions that occur after users connect or meet in person or exchange contact information.

Smoke is not responsible for, and does not supervise, monitor, or control any offline meetings, interactions, or conduct between users.

7. Reviews, Ratings, and Feedback
The App may allow users to submit feedback, ratings, or structured reviews of other users.

Such feedback may:
be anonymized
be categorized or standardized
be visible to other users
influence user reputation or matching systems
We may moderate, remove, or retain feedback at our discretion.
You agree not to submit false, abusive, or malicious feedback.

Reviews are user-generated opinions. Smoke does not verify truthfulness. Users may be exposed to subjective or inaccurate assessments. Smoke may remove or modify categories.

We do not guarantee the accuracy, completeness, or reliability of user-generated reviews or ratings.

8. Location and Meetup Features
The App may use location data to:
show nearby userscalculate distance between userssuggest meetup locations
facilitate real-world introductions
Users may select or input meetup locations via mapping tools.

Location accuracy depends on your device settings and permissions.

9. Notifications
You agree that we may send you notifications including:
account activity updates
meetup-related updates
safety or operational alerts
product or feature updates
promotional messages (if enabled)

You may manage notification preferences through device or app settings, except where notifications are necessary for core functionality or safety.

10. Termination
We may suspend or terminate your account at any time, with or without notice, for any reason including:
violation of these Terms
suspected fraud or abuse
safety concerns
operational or legal reasons

You may also delete your account at any time through the App.

11. Disclaimers
The App is provided on an “AS IS” and “AS AVAILABLE” basis.
We do not guarantee:
that users are who they claim to be
that interactions will be safe or successful
that the App will be error-free or uninterrupted
We disclaim all warranties to the maximum extent permitted by law.

12. Limitation of Liability
To the maximum extent permitted by law, Smoke, Inc. shall not be liable for:
any indirect, incidental, special, or consequential damages
any loss, injury, or harm arising from user interactions (online or offline)
any disputes between users

Your use of the App is at your own risk.

13. Indemnification
You agree to indemnify and hold harmless Smoke, Inc., its officers, employees, and affiliates from any claims, damages, liabilities, or expenses arising from:
your use of the App
your violation of these Terms
your interactions with other users

14. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

15. Changes to Terms
We may update these Terms at any time. Continued use of the App after updates constitutes acceptance of the revised Terms.
